Certificate of Absolute Divorce Directions

1. Next to File Number: fill in the file number that the Clerk of Court stamped
on your Divorce COMPLAINT the day you filed it with the court. This can
be found on the top right side of the COMPLAINT under the section marked
IN THE GENERAL COURT OF JUSTICE DISTRICT COURT DIVISION.
2. Under the File Number, fill in the County you are filing in. Example,
if you are filing in Wake County write Wake next to County:.
3. The next section of the CERTIFICATE OF ABSOLUTE DIVORCE is marked
PLAINTIFF. Next to #1 place an X in the box next to Husband or Wife,
whichever applies to you (the PLAINTIFF). Then fill in your first, middle
and last names as they appear on the COMPLAINT.
4. In the PLAINTIFF section next to 2a. fill in the state where you live
(this will be North Carolina) and next to 2b. fill in the county where
you live (this will be Wake if you are filing in Wake County).
5. Next, fill in the DEFENDANT section. Next to #3 place an X next to Husband
or Wife, whichever applies to your spouse (the DEFENDANT). Then fill in your
spouse's first, middle, and last names as they appear on the COMPLAINT.
6. In the DEFENDANT section next to 4a. fill in the state where your spouse
(the DEFENDANT) lives, and next to 4b. fill in the county where your
spouse (the DEFENDANT) lives.
7. The next section is marked MARRIAGE. Next to #5 write the exact
date of your marriage, as it appears on the COMPLAINT. Next to #6,
write the PLACE OF THIS MARRIAGE, the city, county, and state
where you were married.
8. Next to #7 write the NUMBER OF MINOR CHILDREN you and your
husband have. Minor children are under eighteen (18) years of age.
9. Next to #8 write the DATE OF SEPARATION as it appears
on the COMPLAINT.
10. The CERTIFICATION section of the CERTIFICATE OF ABSOLUTE
DIVORCE will be filled out by the Clerk of Court on the day you go
to court to finish your divorce.
