This arrangement is suitable in about ninety percent of all cases. Very few cases end up in court. The fee includes the drafting of a separation agreement, all required Qualified Domestic Relations Orders (to divide retirement plans), deeds, and other supporting documents. The fee also includes all consultations between you, the client, and our firm including phone calls, meetings, email, and any other contact. The fee further includes all negotiation between your spouse and our firm. The estimated fee additionally includes all of the fees often itemized by other firms including postage, fax and photocopy charges. The only additional fees you might incur relate to outside services you elect to purchase such as a real estate appraisal.
The fixed fee detailed below is an estimate and may vary depending upon your unique situation. When you meet with an attorney from Rosen Law Firm you will be provided with an exact fee that will not change during the course of our representation of you. We do not charge by the hour and you never have to worry about the uncertainty that comes from an unpredictable hourly fee. We make you a promise about your fee and we live up to that promise.
Initial Consultation: $300
Total Fees: $11,000 – $30,000
The fixed fees detailed below cover all steps involved in resolving your situation when it is necessary to file a lawsuit and go to court. These fees are paid in three phases. When a lawsuit is filed with the court we are often able to reach agreement before the matter actually goes to trial. Any fees unpaid at the time of settlement are waived and you pay only the amount you have paid up to that
1. First Phase – The “Initiation Fee” is due when you hire the firm to begin the lawsuit.
2. Second Phase – The “Trial Preparation” fee is generally due 75 days after the filing of the lawsuit.
3. Third Phase – The “Trial Fee” is generally due 45 days before each trial. There are sometimes several trials, on different issues, in one case. Often, we have one trial and then reach agreement on the other issues without the need for additional trials. So that you only pay for the trials you actually reach, we break the fee for this phase down into each separate trial. Again, any issue reaching trial incurs a fee 45 days before the trial.
4. The fixed fees detailed below are an estimate and may vary depending upon your unique situation. When you meet with an attorney from Rosen Law Firm you will be provided with an exact schedule of fixed fees that will not change during the course of our representation of you. Again, you may not end up paying all of the scheduled fixed fees if we reach agreement before the matter actually goes to trial. We do not charge by the hour and you never have to worry about the uncertainly that comes from an unpredictable hourly fee. We make you a promise about your fee and we live up to that promise.
