What Is a Divorce?

Divorce is the legal dissolution of marriage. When you divorce, a court changes your legal status so that the rights and obligations you obtained when you got married are removed. These rights include tax benefits (filing joint return), estate planning benefits (inheriting part of spouse’s estate), and employment benefits (family participation in group health plan). The primary obligation removed by divorce is the need to maintain sexual fidelity. It is important to keep in mind that these rights and obligations are not removed until the divorce is final. This raises a number of questions about your conduct during separation. We will address those in the article, “Life During Divorce.”
